Welcome to OkSafar! OkSafar.com ("the Platform") is a technology service provided by KBKK Global Technologies India Private Limited (hereinafter referred to as "KBKK", "We", "Us", "Our"). These Terms & Conditions ("Terms") govern your access to and use of the Platform and its associated services. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
OkSafar acts solely as a technology platform and marketplace connecting individuals seeking religious travel packages ("Users") with independent travel agents and tour operators ("Agents") who list their packages on the Platform. KBKK/OkSafar is not a travel agency, does not provide travel services itself, and is not a party to the transactions or agreements made between Users and Agents.
Offline Bookings Disclaimer: While Users may discover Agents and packages on the Platform, OkSafar / KBKK takes no responsibility for any bookings, payments, agreements, or service fulfillments that occur entirely offline or outside the communication and payment channels listed or facilitated by the Platform. Our Terms, including any provisions for dispute assistance, apply only to interactions and transactions initiated and managed using the information (e.g., verified contact details, designated bank accounts) provided within the OkSafar Platform.
"Agent" refers to an independent travel agent or tour operator registered on the OkSafar Platform to list and offer travel packages.
"User" refers to any individual who accesses or uses the OkSafar Platform, including browsing packages or interacting with Agents.
"Platform" refers to the OkSafar.com website, associated mobile applications, and services.
"Services" refers to the features and functionalities provided by the Platform that facilitate the connection and interaction between Users and Agents.
To access certain features (primarily for Agents, but potentially for Users in the future), registration for an account may be required. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
Agents are solely responsible for the accuracy, completeness, and legality of all information they provide on the Platform, including package details, pricing, availability, inclusions, exclusions, and cancellation policies. Agents are responsible for fulfilling the travel services offered in their packages. OkSafar does not verify all package details provided by Agents and does not guarantee the quality, safety, suitability, or legality of the services offered by Agents.
Direct Transactions: All financial transactions, including payments and refunds for tour packages, occur directly between the User and the Agent. OkSafar / KBKK is not involved in processing, handling, or guaranteeing these payments or refunds (KBKK/OkSafar has right to initiate legal action against any Agent who is found to be involved in any fraudulent activity and recover the amount from the Agent).
CRITICAL - Use Designated Bank Details Only: Users MUST make payments ONLY to the specific bank account details officially provided by the Agent within the OkSafar Platform's package details section or Payment Details section for the specific tour being booked. OkSafar / KBKK Global Technologies India Private Limited WILL NOT be responsible or liable for any disputes, losses, or fraud arising from payments made by Users to any alternative bank accounts (e.g., personal accounts, different company accounts suggested by the Agent outside the Platform) or for cash payments made without obtaining a valid, verifiable receipt.
Cancellation Policies: Cancellation policies are determined solely by the Agent and can vary significantly based on the package and timing. Users are strongly advised to contact the Agent directly to discuss and confirm the specific cancellation policy before making any payment or submitting documents for processing. Understanding the cancellation policy beforehand is the User's responsibility.
Refunds: Any refunds are processed directly between the User and the Agent according to the Agent's confirmed cancellation policy. OkSafar does not handle or guarantee refunds.
To the fullest extent permitted by law, OkSafar / KBKK Global Technologies India Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) Your access to or use of or inability to access or use the Platform; (b) Any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other Users or Agents; (c) Any content obtained from the Platform; (d) Unauthorized access, use, or alteration of your transmissions or content; (e) The quality, safety, legality, or fulfillment of travel services provided by Agents; (f) Any disputes or issues arising directly between Users and Agents, including payment disputes, service quality issues, or cancellations.
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
KBKK Global Technologies India Private Limited / OkSafar reserves the absolute right to suspend, terminate, or block any Agent account, or remove specific package listings, without prior notice, if an Agent is found to be:
Engaging in repeated discrepancies or unreasonable delays between committed tour dates/itineraries and actual service delivery.
Having unresolved issues related to the settlement or acknowledgement of payments received directly from Users.
Failing to provide Users with relevant invoices generated within India (e.g., Airline tickets, Visa invoices) upon reasonable request, where applicable.
Listing packages with materially misleading or inaccurate information (regarding pricing, inclusions, itinerary, accommodation standards, etc.).
Violating any terms outlined in this agreement, engaging in fraudulent or illegal activities, or receiving excessive verified complaints from Users.
Once an Agent subscribes to any plan on the OkSafar platform, there is no cancellation or refund applicable to the subscription plan. All payments made by Agents for subscription plans are non-refundable under any circumstances.
It is important to note that OkSafar does not collect payments from Users for their tour packages. Therefore, refund and cancellation policies related to tour packages are not applicable to OkSafar. Users must make direct payments to the Agents for their tour packages or visit the tour operator's office for payments. Detailed payment information is provided on the tour package details page.
While OkSafar/KBKK is not a party to the agreement between Users and Agents, We reserve the right, at our sole discretion (but have no obligation), to facilitate communication or mediate disputes between Users and Agents concerning issues arising directly from the use of the Platform. This may include disputes regarding payments made to designated accounts, document provision facilitated via the platform, or significant deviations from package details listed on the Platform.
In instances where OkSafar/KBKK has reasonable grounds to suspect fraudulent activity, scam, or illegal conduct by an Agent affecting Users of the Platform, We reserve the right to take further action. This may include sharing information with law enforcement authorities and, where legally permissible and deemed appropriate by Us, initiating or supporting legal proceedings against the Agent.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Kalaburagi City, Karnataka, India.
